Ob rabiate Hausdurchsuchungen und Razzien bei Kritikern der Corona-Politik oder Gewalt gegen friedliche Demonstranten. Die Polizei fällt in den letzten zwei Jahren durch bedenkliche Aktionen auf. Ebenso wie der Verfassungsschutz. Kriminologe, Polizei- und Politikwissenschaftler Björn Lars Oberndorf sieht Anzeichen, dass die Institution, die unsere Verfassung, unsere Grundrechte schützen soll, Erfüllungsgehilfe der Regierung geworden ist. Oberndorf ist 1. Vorsitzender der „Polizisten für Aufklärung“ und kennt die Stimmungslage der Beamten.

Interview mit Björn Lars Oberndorf (deutsch)

Milena Preradovic: Rabiate Hausdurchsuchungen und Razzien bei Kritikern der Corona-Politik, Gewalt gegen friedliche Demonstranten, gegen Alte, gegen Kinder, gegen Frauen. So gravierend, dass selbst der Folter-Beauftragte der UNO alarmiert war. Die Polizei fällt in diesen Zeiten durch bedenkliche Aktionen auf. Nicht nur in Deutschland. Bei den Bauern-Protesten in den Niederlanden schossen Beamte grundlos auf einen 16-jährigen. Und auch aus anderen EU Ländern sehen wir Bilder von Polizeigewalt. Was mich beunruhigt: Politik, Verfassungsschutz und Justiz forcieren hierzulande den Druck auf Andersdenkende. Was ist mit Verhältnismäßigkeit, mit der Verfassung? Was denken Polizisten darüber? Und was passiert, wenn sie Zweifel an ihrer Arbeit haben? Darüber sprechen wir jetzt in Punkt Preradovic. Hallo, Björn Lars Oberndorf.

Björn Lars Oberndorf: Hallo.

Milena Preradovic: Ich stelle Sie kurz vor. Sie sind Kriminologe, Polizei und Politikwissenschaftler mit Schwerpunkt Verfassungsrecht. Sie waren bis 2005 selber Polizist und haben für verschiedene Landes- und Bundesbehörden gearbeitet. Seit mehreren Jahren sind Sie Dozent in der politischen Erwachsenenbildung, da unter anderem mit den Schwerpunkten Verhalten, Training, Deeskalation, Konfliktmanagement, Werte, Training, Demokratie, Stärken und interkulturelle Kompetenz. Sie haben aber immer noch sehr viel Kontakt zu Sicherheitsbehörden. Außerdem arbeiten Sie als freier Journalist, und Sie sind Erster Vorsitzender “der Polizisten für Aufklärung”, einem Verein, in dem sich Menschen aus den Bereichen Polizei, Militär, Rettungsdienste, Justiz, Feuerwehrleute sowie Mitarbeiter anderer staatlicher Institutionen mit dem Ziel engagieren, die freiheitliche demokratische Grundordnung zu wahren und zu verteidigen. So steht es auf Ihrer Seite. So reden wir über die Polizei. Polizisten werden inzwischen zu jeder Menge Hausdurchsuchungen und Razzien geschickt wegen angeblicher gefälschter Impfausweise wegen Masken-Attest. Und so weiter. Da hätte man doch früher vielleicht eine Vorladung in seinem Briefkasten gefunden, habe ich mir immer gedacht. Wie steht es denn inzwischen um die Verhältnismäßigkeit? Ein wichtiger Baustein in jedem demokratischen Staat.

Björn Lars Oberndorf: Erst mal vielen Dank für die Einladung und für die Begrüßung. Sie haben vollkommen recht. Das Stichwort oder das Thema Verhältnismäßigkeit war genau der Grund, dass der Verein gegründet wurde. Denn die Kollegen und Kollegin haben sich genau um das Thema Verhältnismäßigkeit Gedanken gemacht. Und Sie haben gerade auch vollkommen zurecht das Thema Vollstreckung Durchsuchungsbeschlüsse erwähnt. Und bei vielen der Haus- oder Wohnungsdurchsuchungen der letzten zwei Jahre, muss man die Frage der Verhältnismäßigkeit auf den Prüfstand stellen. Denn nach meiner Erfahrung, aber auch der Erfahrung von vielen Kollegen und Kolleginnen ist die Verhältnismäßigkeit nicht in jedem Fall gewahrt. Wir denken an Dr. Paul Brandenburg oder wir denken an viele, viele andere Leute der letzten Monate, wo zumindest der Anfangsverdacht besteht, dass auch ein Tatvorwurf konstruiert wurde oder die Frage erlaubt sein muss, welche Beweismittel durch diese Vollstreckung des Durchsuchungsbeschluss aufgefunden werden sollen.

Milena Preradovic: Wie wird denn das Thema innerhalb der Polizei diskutiert?

Björn Lars Oberndorf: Also bei den Kollegen und Kollegen, mit denen ich Kontakt habe, sehr kontrovers, also nicht nur im Verein. Wir sind ja auch als Verein im Außen sehr gut vernetzt, auch zu anderen Behördenvertretern. Und da wird es schon sehr kontrovers diskutiert, weil man muss sich natürlich vorstellen, wenn ich wirklich aufgrund eines vermeintlichen Verstoßes gegen das Kunsturheber-Gesetz gleich einen Durchsuchungsbeschluss vollstrecke, auch unter der Hinzuziehung teilweise von polizeilichen Spezialkräften, also ein Vorgehen, was man eigentlich aus dem Bereich der Schwer- und Schwerst-Kriminalität kennt, dann muss diese Frage erlaubt sein. Und das wird auch diskutiert.

Milena Preradovic: Man hat ja schon den Eindruck, es geht darum, Kritiker der Regierungspolitik einzuschüchtern, oder?

Björn Lars Oberndorf: Der Eindruck ist auf jeden Fall nicht von der Hand zu weisen. Wir haben jetzt ja auch als Verein ein Projekt gestartet, wo es genau darum geht, diese Vollstreckung, der Durchsuchungsbeschlüsse, uns mal ganz genau im Detail anzuschauen, das Ganze zu analysieren und auszuwerten und dann aber auch der ständigen Innenministerkonferenz, aber auch den sogenannten Leitmedien zur Verfügung zu stellen. Denn diese Fragen, die Sie gerade aufgeworfen haben, sind vollkommen legitim und müssen gestellt werden. Denn wenn wir einen Rechtsstaat haben und wenn wir eine Demokratie habe, wovon ich immer noch ausgehe, dann ist es natürlich ganz, ganz wichtig, dass polizeiliches Handeln jederzeit überprüfbar ist. Und wir werden sehen, wie auf diese Ergebnisse des kleinen Forschungsprojektes reagiert werden wird.

Milena Preradovic: Das heißt, Sie fordern in irgendeiner Form die Unterlagen an und schauen mal, was da warum dort überhaupt Durchsuchungsbefehle vollstreckt wurden und was gefunden wurde?

Björn Lars Oberndorf: Also wir haben einen Fragebogen entwickelt. Wir hoffen, das wird in zwei Wochen wahrscheinlich online gehen, es hat sich etwas verzögert. Wir hoffen, dass möglichst viele Menschen an dieser Befragung teilnehmen, die selber Adressat dieser polizeilichen Maßnahmen waren. Natürlich sind die Daten bei uns gesichert und es wird auch anonymisiert. Und dann schauen wir wirklich: Was war der Tatvorwurf? Was sollte aufgefunden werden? Wie war das Vorgehen der Einsatzkräfte vor Ort? Wie wurde auch mit den Bürgern umgegangen? Kam gegebenenfalls auch unmittelbarer Zwang zum Einsatz? Und all das wollen wir uns ganz in Ruhe anschauen, um dann wirklich auch ein Ergebnis präsentieren zu können. Denn dieses Vorgehen und das kann man auf jeden Fall festhalten, ist auf jeden Fall sehr irritierend. Und man darf und muss die Frage stellen, ob es da wirklich um Beweismittel im Rahmen eines Strafverfahrens geht oder um es um die Einschüchterung bestimmter Personengruppen geht.

Milena Preradovic: Was für einen Geist herrscht denn bei der Polizei vor? Eher der “Wir sind Bürger in Uniform-Geist” oder so der Geist, Befehle befolgen. Weiß man ja von außen irgendwie nicht.

Björn Lars Oberndorf: Das ist das ist natürlich schwierig zu beantworten. Also wir haben gerade die letzten zwei Jahre, es wird ja sehr, sehr viel mit der Angst der Menschen gespielt, Angst vor der eigenen eigenen Erkrankung, Angst vor der eigenen Sterblichkeit. Es geht sehr, sehr viel um Glaubenssätze. Es geht sehr, sehr viel um Urvertrauen. Warum erwähne ich das? Jede Berufsgruppe zieht natürlich bestimmte Persönlichkeits-Charaktere an, um es mal ganz platt auszudrücken und ohne es natürlich verallgemeinern zu wollen. Jemand, der gegebenenfalls Kindergärtner wird, hat von der Persönlichkeitsstruktur andere Elemente als jemand, der Soldat oder Polizeibeamter wird. Das ist erst mal komplett wertneutral ausgedrückt. Das heißt, Berufsgruppen wie die Polizei oder das Militär sind natürlich erstmal systemimmanent hierarchisch aufgebaut. Das muss auch logischerweise sein, denn gerade in der Lage oder bei Großschadens-Ereignissen kann ich natürlich wie bei der Feuerwehr auch nicht nicht jeden einzelnen Punkt, jede Anweisung, jeder Anordnung diskutieren. Das heißt, natürlich habe ich eine Hierarchie und natürlich werde ich auch in hierarchischen Strukturen sozialisiert. Das ist Punkt 1. Dazu kommt, dass natürlich gerade bei Behörden auch wie der Polizei, eine ganz bestimmte, ja Behörden-Kultur gibt, eine sogenannte Cop-Culture. Da hat Professor Dr. Rafael Bär auch sehr, sehr viel zu geforscht und auch Bücher zu veröffentlicht. Es gibt also einen großen Korpsgeist. So, das muss man wissen. Also einerseits natürlich die Persönlichkeitsstruktur, andererseits eine sehr starke Hierarchie. Auf der anderen Seite aber auch eine Angst, gegebenenfalls um die eigene Gesundheit, wie bei allen Menschen vielleicht der letzten zwei Jahre. Dann auch natürlich persönliche Sorgen, “ich möchte Karriere machen”, “ich möchte befördert werden”, “ich muss mein Kredit bezahlen”, “ich möchte Geld verdienen”. Und das Ganze ist, nennen wir es mal, eine Gemengelage bei der Polizei. Und warum ich das so deutlich erwähne. Es ist natürlich gerade in geschlossenen Einheiten der Polizei wie bei den Einsatz-Hundertschaften gegebenenfalls noch deutlich schwieriger, eine andere Meinung zu kommunizieren und dafür gerade zu stehen als in anderen Berufsgruppen.

Milena Preradovic: Das sind die diese Einsatz-Hundertschaften die bei Demos eingesetzt.

Björn Lars Oberndorf: Genau wie bei Großschadenslagen, bei Demonstrationen, bei Versammlungen usw eingesetzt werden. Genau.

Milena Preradovic: Sind die extra geschult, anders geschult als der normale Freund und Helfer?

Björn Lars Oberndorf: Also Einsatz-Hundertschaften haben nochmal ein spezielles Einsatz-Hundertschaftstraining, was ich damals im Rahmen der Ausbildung oder des dualen Studiums auch durchlaufen habe und werden dann natürlich noch mal in Einheiten geschult. Also sie werden noch mal für diese Lagen, wie es polizeilich heißt und für die Versammlung geschult, gerade auch, was das ganze Polizei taktische Vorgehen angeht.

Milena Preradovic: Gibt es denn unter denen kritische Polizisten oder werden die vorher aussortiert?

Björn Lars Oberndorf: Grundsätzlich ist ja der Grundgedanke, dass auch bei der Polizei der Staatsbürger in Uniform vorherrscht und Polizeibeamte sind ja auch für die Rechtmäßigkeit ihrer dienstlichen Maßnahmen, polizeilichen Maßnahmen vollumfänglich persönlich haftbar zu machen. Und sie werden auch sehr gut ausgebildet. Und wir haben auch bei der Polizei und auch in geschlossenen Einheiten sehr, sehr viele kritische Menschen. Das heißt aber nicht, dass die alle demonstrieren. Das heißt auch nicht, dass die alle wirklich sich, ich sage es mal, outen. Das heißt auch nicht, dass die alle nach draußen gehen, aus den verschiedensten Gründen. Das geht dann ja sehr viel schon in den Bereich der Psychologie. Man möchte auch nicht ausgegrenzt werden, man möchte zur Ingroup gehören. Und so weiter. Aber ja, über den Verein, über die Kontakte, die wir haben, über die Gespräche, die wir führen, es gibt also deutlich mehr kritische Polizeibeamte, als das gegebenenfalls so nach außen dringt oder wirkt.

Milena Preradovic: Womit müssen denn Polizisten rechnen, wenn sie sich öffentlich kritisch äußern?

Björn Lars Oberndorf: Es kommt immer ganz darauf an, ob ein Amtsbezirk hergestellt werden kann oder nicht. Wobei, da muss man mittlerweile aufpassen, denn bei vielen Kollegen, die bei uns im Verein sind, gab es schon sehr, sehr früh die Einleitung von disziplinar-rechtlichen Maßnahmen und teilweise mit Begründungen, die ich als zumindest kleiner Rechtswissenschaftler nicht nachvollziehen kann. Das heißt, so weit nehmen wir mal Bernd Bayerlein, den zweiten Vorsitzenden. Bernd Bayerlein, als zweiter Vorsitzender, hat ja sehr früh auch auf öffentlichen Versammlungen gesprochen, und aufgrund dieser Tätigkeit auf öffentlichen Versammlungen zu sprechen, wurde halt ein Disziplinarverfahren eingeleitet und es wurde auch ein Amtsbezug hergestellt. Ob es wirklich einen Amtsbezug gibt, das wird es zu klären geben in der Zukunft. Aber es gibt ganz oft Vorwürfe, die gehen dann in die Richtung Verstoß gegen das Neutralitätsgebot, was eigentlich für Polizeibeamte gilt. Das geht aber auch Verstoße gegen die außerdienstliche Wohlverhaltens-Pflicht, die gibt es auch beamtenrechtlich. Oder es geht wirklich darum, dass man quasi einen Amtsbezug hatte bei den Äußerungen, die man getätigt hat. Bei manchen dieser Disziplinarverfahren, die uns im Verein vorliegen, denn wir versuchen natürlich, die Kollegen zu unterstützen, wirken die Vorwürfe recht konstruiert. Das muss man auch dazu sagen. Und es ist sehr fraglich, ob es wirklich verwaltungsgerichtlichen Verfahren langfristig standhalten wird.

Milena Preradovic: Haben Sie mal ein Beispiel, damit man sich das vorstellen kann?

Björn Lars Oberndorf: Ich habe zum Beispiel einen Kollegen, in seiner Disziplinar-Verfügung steht drin als Vorwurf, dass er seine seine Kollegen und Kolleginnen zur Verhältnismäßigkeit quasi ermahnt hat, im Sinne der Maßnahme. Das muss ich auf der Zunge zergehen lassen. Also gerade die Verhältnismäßigkeit ist der Grundsatz jeglichen polizeilichen Handelns. Und da stehen also wirklich teilweise Dinge schwarz auf weiß drin, wo man eigentlich, nur um es mal ganz platt auszudrücken, mit den Ohren schlackern kann. Ich kann leider in vielen Bereichen nicht mehr ins Detail gehen, was diese Disziplinarverfahren angeht, weil nicht alle Kollegen, die bei uns im Verein Mitglied sind, gehen an die Öffentlichkeit. Und aber es geht meistens um die Verstöße Neutralitätsgebot, außerdienstliches Wohlverhalten. Oder man sagt, dass die Leute dem Ansehen der Polizei geschadet haben. Das sind so meistens die Vorwürfe, um die es geht.

Milena Preradovic: Also es ist wie in anderen Branchen auch. Es ist schon ein ziemlicher Druck da.

Björn Lars Oberndorf: Es ist ein sehr großer Druck. Und das ist auch das, was mich auch in diesem Sonderbericht vom Landesamt für Verfassungsschutz sehr gewundert hat, aber auch bei vielen anderen Aussagen. Denn ich lese auch oft in den sogenannten Leitmedien, dass es ja von Anfang an, also seit mehr als 2020 eine gesellschaftliche Diskussion, eine offene Diskussion über die Maßnahmen gab. Und ich lese auch, dass jeder legitime Kritik äußern durfte, auch als Beamter. Das habe ich so nicht erlebt. Ich habe das ganz anders erlebt, also gerade in meiner Funktion als erster Vorsitzender. Wir hatten eine, meine Wahrnehmung, wir hatten eine Art Hurrapatriotismus, das heißt, wer auch nur bedingt irgendwas in Frage gestellt hat, was die Verhältnismäßigkeit angeht oder was den Sinn bestimmter Maßnahmen angeht, wie zum Beispiel nächtliche Ausgangssperren oder Lockdown. Ganz zu schweigen von der Impfung. Ich habe das nicht erlebt, dass es ein breiten gesellschaftlichen Diskurs gab. Und ich habe auch nicht erlebt, dass man legitime Kritik äußern durfte. Das war mein Eindruck der letzten zwei Jahre und der Eindruck wird auch durch die Kollegen und Kolleginnen im Verein bestätigt.

Milena Preradovic: Sie haben ihn gerade schon erwähnt, den Sonderbericht des Landesverfassungsschutzes NRW. Und da wird ja Ihr Verein “Polizisten für Aufklärung” ganz explizit erwähnt. Da wird Ihnen also Unterwanderungs-Strategie vorgeworfen, indem Sie die Legitimität des derzeitigen Regierungshandelns in Zweifel ziehen und Polizeibeamte zur Befehlsverweigerung aufrufen, das ist schon starker Tobak. Was sagen Sie denn zu diesen Vorwürfen, die ja genau gegen Sie gehen?

Björn Lars Oberndorf: Also ich habe mir den ganzen Sonderbericht natürlich durchgelesen. Und vorweg, was ich schon mal verraten kann, der Verein, vertreten durch mich als ersten Vorsitzenden, prüft auch strafrechtliche Schritte. Aber da muss man durchaus prüfen, ob da bestimmte Straftatbestände wie beispielhaft üble Nachrede oder Verleumdung gegebenenfalls verwirklicht wurden. Es ist ein komplettes Framing, um es einigermaßen sachlich auszudrücken. Das Landesamt für Verfassungsschutz Nordrheinwestfalen geht von einem komplett falschen Narrativ aus. Das fängt schon damit an, dass in dem ganzen Sonderbericht das, was Sie gerade erwähnt haben, eingetragener Verein überhaupt nicht erwähnt wird. Das heißt, es wird überhaupt nicht erwähnt, dass es sich bei “Polizisten für Aufklärung” um einen ordentlichen, nach deutschem Recht eingetragenen Verein handelt, also eine eigene juristische Person, die durch den Vorstand vertreten wird. Wir haben eine Satzung. In der Satzung ist ganz klar geregelt, worum es uns geht. Es ist ganz klar geregelt, dass wir im Rahmen der FDGO uns bewegen und dass es uns um die Verhältnismäßigkeit der Maßnahmen geht. Und wenn man sich da mal ich habe mir das natürlich auch hier markiert, wenn man sich diese Aussagen anguckt, dass wir die Sicherheitsbehörden unterwandern wollen aus der sogenannten Corona Protestler Szene. Das ist ja genau falsch. Der Verein hat sich nicht gegründet, um irgendetwas zu unterwandern. Der Verein wurde gegründet, unter anderem von Aktiven und ehemalige Polizeibeamten, die sich eben Sorgen genau um die Verhältnismäßigkeit gemacht haben. Das heißt also, genau andersherum wird ein Schuh draus. Das heißt, der ist jetzt nicht von Hänschen Müller gegründet worden, um Polizeibeamte und Beamtinnen zu indoktrinieren, sondern er ist gegründet worden von Polizeibeamten, um dementsprechend die eigene Besorgnis deutlich zu machen.

Björn Lars Oberndorf: Es ist ja ein riesiger Unterschied von der intrinsischen Motivation und vom Narrativ her. Ich suche gerade die Seite noch mal raus, die Sie gerade vorgelesen haben, denn das Ganze geht ja noch weiter, was uns quasi vorgeworfen wird. Und es ist eine ja, man kann fast davon sprechen, eine sehr perfide Verleumdung-Strategie. Ich erinnere daran, was unser Bundesjustizminister Buschmann vor ein paar Tagen gesagt hat. Er hat gesagt: “unwahre Tatsachenbehauptungen oder falsche Tatsachenbehauptungen gehören nicht ins Repertoire von Demokraten”. Und wenn ich mir dann diesen Bericht hier durchlese und was uns hier vorgeworfen wird, ist das, wie Sie es gerade richtig gesagt haben, sehr harter Tobak, denn hier steht ja drin dabei spielt unter anderem die sogenannte PolifA, “Polizisten für Aufklärung”, Telegramm und eine Internetseite eine wesentliche Rolle. Das ist das, was ich gerade meinte. Kein Wort vom eingetragenen Verein, kein Wort davon, wer unsere Mitglieder sind, dass wir einen ordentlichen Vorstand haben, dass wir ordentlich im Vereinsregister eingetragen sind und dann, was Sie auch vorgelesen haben, Befehlsverweigerung. Wir rufen niemanden auf, einen Befehl zu verweigern. Wir verweisen darauf, dass man, wenn man sich nicht sicher ist, dass diese dienstliche Maßnahme rechtmäßig ist oder die Anordnung, die Anweisung, wie auch immer, dass man dann durchaus verpflichtet ist, zu remonstrieren. Denn man darf ja eins nicht vergessen, Polizeibeamte leisten ihren Eid auf das deutsche Grundgesetz, nicht auf eine Corona-Schutz-Verordnung, nicht auf das Infektionsschutzgesetz, sondern auf das Grundgesetz unseres Landes im Verfassungsrange. Und das ist genau der Grund. Sie haben recht, es ist eine Verleumdung.

Milena Preradovic: Ich frage mich ja auch, was ist daran illegal, die Legitimität des Regierungshandelns anzuzweifeln? Ist das nicht vom Grundgesetz gedeckt? Darf ich das nicht?

Björn Lars Oberndorf: Natürlich. Also Demokratie ist ja ein Idealzustand. Wir werden Demokratie nie erreichen, also wirklich aus politikwissenschaftlicher Sicht. Und Demokratie lebt davon, vom mündigen Bürger. Und das bedeutet auch, dass man die Regierung zur Ordnung ruft und dass man auch Regierungshandeln in Frage stellt. Das ist ja genau das, was der mündige Bürger machen soll. Und es ist ja nicht so, dass wir nach über zwei Jahren nicht auch ganz, ganz viele Gerichtsurteile haben, die uns Recht geben. Also so ist das ja nicht. Das heißt, es ist ja nicht so, dass wir im luftleeren Raum agieren, sondern wir beziehen uns ja auch auf Gerichtsurteile. Und dass man als Bürger die Legitimität des Regierungshandelns in Zweifel ziehen darf, ist eine Bürgerpflicht. Und Ulrike Guerot hatte so schön gesagt: “Demokratie ist öffentlicher Streit und nicht nach außen dargestellter Konsens”. Und das, was hier in diesem Bericht steht, fügt sich meiner Meinung nach nahtlos ein in diesen ganzen Bereich der sogenannten Cancel Culture. Was ich sagen kann, was ich nicht sagen kann, worüber geredet werden darf oder wie auch Frau Dunja Hayali so nett gesagt hat: “Doch wir haben Meinungsfreiheit. Man muss danach mit den Konsequenzen leben”. Nein, das ist eben nicht das, was Meinungsfreiheit meint nach Artikel fünf Grundgesetz.

Björn Lars Oberndorf: Und das heißt also, was wir jetzt ganz konkret machen werden? Ich werde als Erster Vorsitzender zum einen dem Landesamt für Verfassungsschutz ein Gespräch anbieten. Das habe ich noch nicht getan. Das werde ich tun. Das kündige ich hiermit an, weil wir durchaus natürlich jederzeit gesprächsbereit sind. Und parallel dazu prüfen wir strafrechtliche Schritte, denn es sind keine Unterwanderungs-Strategien. Und wenn es von Anfang an einen breiten Diskurs gegeben hätte und wenn gerade auch Beamte im Rahmen ihrer dienstlichen Möglichkeiten Kritik hätten üben können, wäre der Verein wahrscheinlich gar nicht gegründet worden.

Milena Preradovic: Es gibt ja auch den Verfassungsschutzbericht, den aktuellen, den bundesweiten. Und da wurde ja jetzt der Phänomen-Bereich der verfassungsschutz-relevanten Delegitimierung des Staates eingeführt. Schwammig. Da geht es um Menschen, die nach Ansicht des Verfassungsschutzes staatliche Institutionen oder deren Repräsentanten verächtlich machen und so das Vertrauen der Bevölkerung in den Staat untergraben. Auch das war ja eigentlich nicht wirklich illegal. Das ich muss ja eigentlich auch kein Vertrauen in den Staat haben. Ich habe so ein bisschen Verdacht wird hier undercover eine neue Rechtsordnung eingeführt?

Björn Lars Oberndorf: Zumindestens muss man die Frage stellen, was das wirkliche Ziel ist. Wir haben ja genug Phänomen-Bereiche, extremistische Phänomen-Bereiche beim Bundesamt für Verfassungsschutz, ob das Links, Rechts ist, Islamismus, Ausländerkriminalität und so weiter. Das sind ja all diese Kategorien, politisch-motivierte Kriminalität. Und da man aber die Corona-Protestler-Szene, so wie es auch der Sonderbericht nennt, nicht fassen konnte, hat man halt die verfassungsschutz-relevante Delegitimierung des Staates eingefügt. Und da läuft es mir als Kriminologe und Politikwissenschaftler ganz kalt den Rücken runter. Denn Delegitimierung des Staates, ich will keine Vergleiche ziehen, da bin ich auch gleich mit da drin, genau wie Verächtlichmachung von Politikern und Politikerinnen: Es gibt keine demokratische Pflicht, dem Staat zu vertrauen. Es gibt keine demokratische Pflicht, mit allem, was der Staat macht, einverstanden zu sein. Nein, genau das Gegenteil ist der Fall. Der Bürger muss den Staat zur Ordnung rufen, wenn er das Gefühl hat, dass man bestimmte Grundsätze der Rechtsstaatlichkeit verlässt. Und gerade auch mit dieser neuen Kategorie, wenn man allein mal guckt hier, ich bin gerade mal beim Sonderbericht, da wird ja auch der Kritiker des Regierungshandelns definiert. Das muss ich auf der Zunge zergehen lassen. Wer Kritik in Sachfragen äußert, Kritik in Sachfragen äußert und nicht per se die Gesellschaft in ihrer Verfasstheit als demokratischer Rechtsstaat überwinden will, dennoch wird diese Person schon mitunter Corona-Protestlern erfasst, also Kritik in Sachfragen. Das ist eine Säule einer freien Gesellschaft, einer Demokratie, Kritik in Sachfragen zu äußern und dann auch hier: “neu definiert werden soll die Gruppe der Impfgegner. Hierzu wird gezählt, wer die Notwendigkeit bzw Wirksamkeit der Corona Schutzimpfung in Frage stellt bzw ablehnt”. Also dann bin ich Impfgegner. Ich bin zwar gegen alles mögliche geimpft, aber ich war ja auch ganz früher im Rettungsdienst, dann bei der Polizei. Aber ja, die Notwendigkeit und die Wirksamkeit, die stelle ich in Frage. Das ist richtig.

Milena Preradovic: Ja, das tun ja auch verschiedene Wissenschaftler, das tun sogar ganze Regierungsberichte. Und so weiter. Das alles kommt vom Verfassungsschutz, wo ja im Wort schon steht, dass der Verfassungsschutz die Verfassung schützen soll. Tut er das?

Björn Lars Oberndorf: Da hat auch Professor Dr. Moosweg, war es glaube ich, eine spannende Abhandlung zu geschrieben. Das ist eine der sehr umstrittenen Fragen, auch im Bereich der Politikwissenschaften. Denn wenn wirklich eine Behörde das Grundgesetz im Verfassungsrange schützt, dann müsste diese Behörde ja komplett unabhängig sein von äußeren Einflüssen. Und das Landesamt für Verfassungsschutz untersteht natürlich dem Bundesinnenministerium Nordrheinwestfalen. Das Bundesamt für Verfassungsschutz untersteht dem Bundesinnenministerium. Und da ist natürlich schon mal die Frage, wenn ich in normale Verwaltungsstrukturen eingebunden bin und ich möchte nun mal die Frage in den Raum stellen, gegebenenfalls nur mal rein hypothetisch, die Landes- oder Bundesregierung, die Verfassung bricht, ich aber in den Strukturen über die jeweiligen Fachminister eingebunden bin, wie frei kann ich dann wirklich agieren und wie frei kann ich wirklich handeln? Denn man darf ja nicht vergessen, auch die Mitarbeiter beim Landesamt für Verfassungsschutz sind primär Beamte. Nicht alle, aber primär. Das heißt sie unterliegen auch dem Beamtenstatus-Gesetz. Sie unterliegen genau dem, was vielen unserer Mitglieder vorgeworfen wird, also wenn sich etwa zu äußern würden oder vielleicht andere Handlungen durchführen würde. Ich formuliere es mal sachlich und diplomatisch: Man kann die Frage stellen, ob der Verfassungsschutz wirklich die letzten zwei Jahre seit März 2020 noch unsere Verfassung schützt oder eher das Regierungshandeln? Und das ist eben nicht deckungsgleich, auch wenn das gerne so dargestellt wird.

Milena Preradovic: Naja, ob es die nur die letzten zwei Jahre sind, aber in den letzten zwei Jahren ist ja gut wie ein Brennglas. Das wird ja oft gesagt. Ja, und in den letzten zwei Jahren haben wir ja auch gesehen, wie Kritiker der Politik, also das, was wir ja schon gesagt haben, legitime Kritiker, Menschen, die einfach hinterfragen und kritisieren und auch Menschen, die sich nicht haben spritzen lassen wollen, die werden systematisch diffamiert, kritisiert, diskreditiert, ausgegrenzt, quasi entmenschlicht und ja auch von der Politik, wie ich das empfinde, für vogelfrei erklärt. Was sagt denn die Verfassung dazu?

Björn Lars Oberndorf: Na gut, was unser unser Grundgesetz im Verfassungsrange dazu sagt, das ist sehr eindeutig. Wir haben nicht nur einen Minderheitenschutz in Deutschland, wenn wir jetzt mal zum Beispiel Geimpfte und Ungeimpfte nehmen, sondern wir sind alle vor dem Gesetz gleich. Nur mal ein Beispiel zu nennen wir haben Meinungsfreiheit. Es findet keine Zensur statt. Das ist alles die Verfassungstheorie. Das was wir momentan gerade die letzten zwei Jahre, Sie haben vollkommen recht, es sind in den letzten zwei Jahren kommen bestimmte Dinge an die Oberfläche, die wir schon deutlich länger beobachten können, ist die Verfassungsrealität. Und das ist genau der Punkt. Es findet eine ganz massive, eine ganz massive Entmenschlichung durch Sprache statt. Eine Dehumanisierung. Nicht nur von Seiten der Politik, sondern auch durch die sogenannten Qualitäts- oder Leitmedien. Ich nenne nur mal ein paar Beispiele, hatte ich mich vor kurzem in Hamburg zu geäußert bei einer Kundgebung oder Versammlung. Es geht darum “Blinddarmfortsatz, Sozial-Schädlinge, Trittbrettfahrer der Pandemie, kann man die eigentlich nicht nach Madagaskar verfrachten”, “müssen sozial geächtet werden”. Das waren ja alles Äußerungen und nur kleine Beispiele, die von bestimmten Repräsentanten der Landes- und Bundesregierung oder von angesehenen Persönlichkeiten getätigt wurden. Da gab es keinen Aufschrei, es gab keine Distanzierung, es gab überhaupt nichts. Das ist Entmenschlichung durch Sprache. Und wenn man dann wirklich überlegt, wie mit den Maßnahmen-Kritikern auch auf den Demonstrationen teilweise umgegangen wurde, wie aber auch mit Menschen umgegangen wird, die auch aus medizinischen Gründen keine Maske tragen können, was ja mittlerweile über das Hausrecht geregelt wird, was juristisch sehr zu hinterfragen ist. Ja, man kriegt den Eindruck, dass diese Menschen in gewisser Art und Weise als vogelfrei betrachtet werden. Richtig.

Milena Preradovic: Haben Sie sie nicht irgendwie Menschen angezeigt wegen Volksverhetzung?

Björn Lars Oberndorf: Wir haben ganz viele Anzeigen erstattet. Also das genau das, was uns immer wieder, immer wieder vorgeworfen wird, dass wir ja, keine Ahnung, Volksverhetzung betreiben. Also die Bewegung jetzt nicht wie als Verein unbedingt. Ich persönlich habe recht viele Anzeigen erstattet wegen 130 Strafgesetzbuch Volksverhetzung. Und ich gebe Ihnen da mal ein Beispiel, damit der geneigte Zuhörer das auch besser fassen kann. Es ist von Funk, ein schon im September 2020 oder noch eher, müsste jetzt nachgucken ein Spiel rausgekommen, das heißt “Play Corona World”. Funk ist ja Südwestrundfunk. Swr ist dafür zuständig, ARD als Intendant zeichnet dafür verantwortlich und Funk richtet sich speziell an junge Menschen. Und in diesem Spiel geht es darum, dass ich eine Krankenschwester spiele, die auf dem Weg zum Supermarkt nach der Arbeit infizierte Menschen quasi desinfizieren muss. Also man muss die in Form eines klassischen Jump and Run Spiel es muss man die platt machen. So wird es auch angekündigt. Kinder, ältere Leute, Prepper, das dann der rechte Aspekt, Sonnenbadende usw und dafür kriege ich dann Punkte. Und dieses Spiel, wenn man sich die Kommentierung zum 130 Strafgesetzbuch anguckt, ist per excellence Volksverhetzung. Es ist Volksverhetzung. Es wurde aber noch nicht mal, noch nicht mal ein Ermittlungsverfahren durch die Staatsanwaltschaft eingeleitet, weil in diesem Kontext zählte es dann unter Artikel fünf “Es ist Satire” und es gab noch 152 StPO keinen Anfangsverdacht, um nur ein Beispiel zu nennen.

Milena Preradovic: Also das ist aber ein Spiel für Kinder und Jugendliche. Aha, also Kinder haben mit Satire relativ wenig am Hut, weiß ich aus Erfahrung. Die verstehen Ironie meist ja nicht mal. Also insofern ist das durchaus bedenklich. Ich habe noch eine Frage zu Polizei. Wir sind ein bisschen auf einen anderen Pfad gekommen, die habe ich vorhin nicht gestellt. Aus den Niederlanden wissen wir ja, dass Polizisten undercover eingesetzt wurden, um als vermeintliche Demonstranten die Stimmung anzuheizen. Also auf so Demos. Und wir werden wahrscheinlich auch wieder Demos haben. Gibt es so was auch bei uns?

Björn Lars Oberndorf: Also es ist das ist ein sehr komplexes und sehr diffiziles Thema, was diese auch europäische Zusammenarbeit angeht. Aber ja, es gibt natürlich Polizeibeamte in Zivil, die eingesetzt werden auf Versammlungen, auch in Deutschland. Erst mal natürlich auch mit der Aufgabe des Beobachtens und des Meldens und gegebenenfalls auch einer Zugriffs-Vorbereitung, dann der BFE-Einheiten, BFE Einheiten sind Beweissicherung zur Festnahme-Einheiten. Das haben wir auf allen Demos gehabt, also Zivilkräfte. Dass es Provokateure gibt, der Verdacht steht zumindestens im Raume, aber nicht erst die letzten zwei Jahre. Also Provokateure gegebenenfalls aus den eigenen polizeilichen Reihen. Wir haben dafür jetzt keinen Beleg momentan und wir können das auch nicht gerichtsfest beweisen. Aber wenn man sich viele Mitschnitte von Demonstrationen anschaut, wenn man sich auch viele quasi in Gewahrsamnahmen anschaut und wie danach in dem geschützten Bereich der Einsatz-Hundertschaften mit diesen Personen umgegangen wurde und wie schnell diese Person wieder im Versammlungsgeschehen war, kann man diesen Rückschluss durchaus ziehen. Aber wir können es nicht beweisen. Also als wichtiger Punkt. Aber der Anfangsverdacht steht im Raum.

Milena Preradovic: Also bei den nächsten Demos könnte man ja vielleicht noch mal ein bisschen mehr drauf achten, oder?

Björn Lars Oberndorf: Ja mittlerweile wird ja fast alles gefilmt. Und gerade von den Demonstrationen August 2020 in Berlin gab es schon durchaus Situationen, die sehr nach danach aussahen, dass nicht nur bestimmte Situationen für die sogenannten Leitmedien dargestellt werden sollten, sondern dass auch bestimmte Personen Polizisten extra provoziert haben. Genau in dem Moment wurde gefilmt. Diese Person war dann Adressat polizeilicher Maßnahmen, war aber dann sehr, sehr schnell wieder im Versammlungsgeschehen. Das heißt, es wäre ein sehr merkwürdiges Vorgehen, wenn es nicht bewusst Provokateure wären. Ob das jetzt wirklich Polizeibeamte sind, das ist eine ganz andere Frage, aber es ist nicht komplett auszuschließen. Das ist ja auch der Punkt. Das haben wir in Berlin ja auch gesehen bei den großen Demonstrationen im August und ich muss dazu sagen, auch Menschen, die vielleicht aus dem rechten Spektrum kommen, dürfen ja demonstrieren. Die haben auch Grundrechte. Das muss mal grundsätzlich erwähnt werden, aber ich weiß nicht, ob Sie selber auch bei den großen Demos in Berlin waren noch im August 2020 und diese extrem heterogenen Menschengruppen gesehen haben. Spannend war schon, dass dann teilweise, wenn bestimmte Medienvertreter vor Ort waren, von den sogenannten Leitmedien genau dann ein bestimmtes Flagge ausgerollt wurde, die danach wieder zusammengerollt wurde. Das sind Sachen, die wir selber als Verein auch dokumentiert haben und das sind schon Punkte, wo ich mir die Frage stellen muss, was ist die Intention dieser Berichterstattung? Die Frage muss in den Raum gestellt werden.

Milena Preradovic: Die müssen wir uns stellen. Die werden wir uns wahrscheinlich auch noch länger stellen. Herr Oberndorf, vielen lieben Dank für diesen schwer interessanten Einblick in die hinter die Polizei-Kulissen und hinter die Verfassungs-Kulissen. Wenn ich das mit dieser Verfassung und unsere Verfassung so sehe und den Verfassungsschutz, mache ich mir langsam richtige Sorgen. Aber ich danke Ihnen sehr herzlich, dass Sie da waren.

Björn Lars Oberndorf: Sehr gerne. Jederzeit. Gerne wieder.

Milena Preradovic: Jo. Tja Leute, die Schlinge wird enger gezogen. Kritiker können jetzt sogar offiziell staatlich beobachtet werden, wenn sie einfach nur von ihrem Recht auf Meinungsfreiheit Gebrauch machen. Milena Preradovic: Rabid house searches and raids on critics of the Corona policy, violence against peaceful demonstrators, against the elderly, against children, against women. So serious, in fact, that even the UN’s torture commissioner was alarmed. In these times, the police are conspicuous for their questionable actions. Not only in Germany. At the farmers’ protests in the Netherlands, officers shot a 16-year-old for no reason. And also from other EU countries we see pictures of police violence. What worries me: politics, constitutional protection and the judiciary are forcing the pressure on dissenters in this country. What about proportionality, about the constitution? What do police officers think about this? And what happens when they have doubts about their work? That’s what we’re talking about now in Point Preradovic. Hello, Björn Lars Oberndorf.

Björn Lars Oberndorf: Hello.

Milena Preradovic: Let me introduce you briefly. You are a criminologist, police and political scientist with a focus on constitutional law. You were a police officer yourself until 2005 and have worked for various state and federal agencies. For several years you have been a lecturer in adult political education, there among other things with a focus on behavior, training, de-escalation, conflict management, values, training, democracy, strengths and intercultural competence. However, you still have a lot of contact with security authorities. You also work as a freelance journalist, and you are the first chairman of “the Policemen for Enlightenment,” an association in which people from the police, military, emergency services, judiciary, firefighters, as well as employees of other state institutions are involved with the goal of preserving and defending the free democratic basic order. That’s what it says on your page. That’s how we talk about the police. Police officers are now sent to any number of house searches and raids because of alleged fake vaccination cards because of mask attest. And so on. In the past, you might have found a summons in your mailbox, I always thought. What about proportionality in the meantime? An important component in every democratic state.

Björn Lars Oberndorf: First of all, thank you very much for the invitation and for the welcome. You are absolutely right. The keyword or the topic of proportionality was exactly the reason that the association was founded. Because the colleagues were concerned precisely about the issue of proportionality. And you have just mentioned also quite rightly the issue of enforcement search warrants. And with many of the house or apartment searches of the last two years, you have to put the question of proportionality to the test. Because in my experience, but also in the experience of many colleagues, proportionality is not maintained in every case. We think of Dr. Paul Brandenburg or we think of many, many other people of the last months, where at least the initial suspicion exists that also an accusation of a crime has been constructed or the question must be allowed, which evidence shall be found by this execution of the search warrant.

Milena Preradovic: How is the topic discussed within the police?

Björn Lars Oberndorf: Well, among the colleagues and colleagues with whom I have contact, very controversial, so not only in the association. As an association, we are also very well networked externally, including with other representatives of the authorities. And there it is discussed very controversially, because you have to imagine, of course, if I really execute a search warrant on the basis of an alleged violation of the Art Copyright Act, even with the involvement of special police forces, i.e. a procedure that is actually known from the area of serious and very serious crime, then this question must be allowed. And that is also being discussed.

Milena Preradovic: One already has the impression that it is about intimidating critics of government policy, isn’t it?

Björn Lars Oberndorf: That impression cannot be dismissed out of hand. As an association, we have started a project that aims to take a detailed look at the execution of the search warrants, to analyze and evaluate the whole thing, and then to make it available to the permanent conference of interior ministers as well as to the so-called leading media. Because these questions that you have just raised are completely legitimate and must be asked. Because if we have a constitutional state and if we have a democracy, which I still assume, then it is of course very, very important that police actions can be verified at any time. And we will see how these results of the small research project will be reacted to.

Milena Preradovic: That is, you request the documents in some form and see what there why search warrants were executed there in the first place and what was found?

Björn Lars Oberndorf: So we have developed a questionnaire. We hope that will go online in two weeks probably, it’s been a little delayed. We hope that as many people as possible will participate in this survey who were themselves the addressees of these police measures. Of course, the data is secured with us and it will also be anonymized. And then we really look at: What was the accusation? What was to be found? What were the actions of the emergency forces on site? How were the citizens dealt with? Was direct coercion also used, if necessary? And we want to look at all of this very calmly in order to be able to really present a result. Because this procedure, and this can be stated in any case, is very irritating. And one may and must ask the question whether it is really about evidence in the context of criminal proceedings or about the intimidation of certain groups of people.

Milena Preradovic: What kind of spirit prevails in the police? Rather the “we are citizens in uniform spirit” or the spirit of following orders. You kind of don’t know that from the outside.

Björn Lars Oberndorf: That’s difficult to answer, of course. In the last two years, we have played a lot with people’s fear, fear of their own illness, fear of their own mortality. It’s very, very much about beliefs. It’s very, very much about basic trust. Why am I mentioning this? Every occupational group naturally attracts certain personality characters, to put it bluntly and without wanting to generalize, of course. Someone who may become a kindergarten teacher has different elements of personality structure than someone who becomes a soldier or police officer. First of all, this is expressed in a completely value-neutral way. This means that occupational groups such as the police or the military are, of course, inherently hierarchical. Logically, this has to be the case, because especially in the situation or in large-scale incidents, I cannot discuss every single point, every instruction, every order, as is the case with the fire department. That is, of course I have a hierarchy and of course I am also socialized in hierarchical structures. That is point 1. In addition, there is of course a very specific, yes, authority culture, a so-called cop culture, especially in authorities such as the police. Professor Dr. Rafael Bär has also done a great deal of research on this and published books on it. So there is a great esprit de corps. So, you have to know that. So on the one hand, of course, the personality structure, on the other hand, a very strong hierarchy. On the other hand, however, also a fear, if necessary, for one’s own health, as with all people perhaps of the last two years. Then also, of course, personal concerns, “I want to make a career,” “I want to be promoted,” “I have to pay my loan,” “I want to earn money.” And the whole thing is, let’s call it a mixed bag in the police department. And why I mention it so clearly. Of course, it is much more difficult to communicate a different opinion and to stand up for it in closed units of the police, such as in the emergency squads, than in other professional groups.

Milena Preradovic: These are the units that are deployed at demos.

Björn Lars Oberndorf: Just as they are deployed for major emergencies, demonstrations, meetings, and so on. Exactly.

Milena Preradovic: Are they specially trained, differently trained than the normal friend and helper?

Björn Lars Oberndorf: Well, the emergency squads have special emergency squad training, which I also underwent during my training or dual studies, and are then of course trained again in units. So they are trained again for these situations, as it is called by the police, and for the assembly, especially with regard to the entire police tactical procedure.

Milena Preradovic: Are there critical police officers among them or are they sorted out beforehand?

Björn Lars Oberndorf: Basically, the basic idea is that the police are also citizens in uniform, and police officers are also personally liable for the legality of their official measures, police measures. And they are also very well trained. And we also have very, very many critical people in the police and in closed units. But that doesn’t mean that they all demonstrate. It also doesn’t mean that they all really, I’ll say it, come out. It also doesn’t mean that they all go outside, for all kinds of reasons. That goes a lot into the area of psychology. People don’t want to be ostracized, they want to belong to the ingroup. And so on. But yes, through the association, through the contacts we have, through the conversations we have, there are clearly more critical police officers than it might appear or appear to the outside world.

Milena Preradovic: What do police officers have to expect when they make critical public statements?

Björn Lars Oberndorf: It always depends on whether a district can be established or not. Whereby, in the meantime, one must be careful, because with many colleagues who are with us in the association, there was already very, very early the initiation of disciplinary-legal measures and partly with reasons, which I cannot understand as at least a small legal scholar. That is, so far we take Bernd Bayerlein, the second chairman. Bernd Bayerlein, as the second chairman, spoke at public meetings very early on, and because of this activity of speaking at public meetings, disciplinary proceedings were initiated and a connection to his office was established. Whether there really is an official connection will have to be clarified in the future. But there are often accusations of violations of the principle of neutrality, which actually applies to police officers. But there are also violations of the off-duty duty of good conduct, which also exists under civil service law. Or it is really about the fact that one had a quasi official connection with the statements that one has made. In some of these disciplinary proceedings that we have received in the association, because we naturally try to support our colleagues, the accusations seem rather contrived. That also has to be said. And it is very questionable whether it will really stand up to administrative court proceedings in the long term.

Milena Preradovic: Do you have an example so that people can imagine this?

Björn Lars Oberndorf: I have a colleague, for example, in his disciplinary order it says as an accusation that he has admonished his colleagues about proportionality, so to speak, in the sense of the measure. I have to let that roll off my tongue. Proportionality is the principle of any police action. And there are really some things in black and white, where you can actually, just to put it bluntly, flap your ears. Unfortunately, I can’t go into more detail about these disciplinary proceedings in many areas, because not all colleagues who are members of our association go public. And but it’s mostly about the violations of neutrality requirement, off-duty good conduct. Or people say that they have damaged the reputation of the police. Those are usually the accusations that are at issue.

Milena Preradovic: Well, it’s the same as in other industries. There is quite a bit of pressure.

Björn Lars Oberndorf: It’s a lot of pressure. And that’s also what surprised me a lot in this special report from the State Office for the Protection of the Constitution, but also in many other statements. Because I also often read in the so-called leading media that there has been a social discussion, an open discussion about the measures from the very beginning, that is, since more than 2020. And I also read that everyone was allowed to express legitimate criticism, even as a civil servant. I didn’t experience it that way. I experienced it quite differently, so just in my capacity as the first chairman. We had a, my perception, we had a kind of jingoism, that is, who even conditionally questioned anything in terms of proportionality or in terms of the sense of certain measures, like nighttime curfews or lockdown. Not to mention vaccination. I haven’t seen that, that there’s been a broad social discourse. Nor have I experienced that legitimate criticism was allowed to be voiced. That was my impression of the last two years and the impression is also confirmed by my colleagues in the association.

Milena Preradovic: You have already mentioned the special report of the State Office for the Protection of the Constitution of North Rhine-Westphalia. And there your association “Policemen for Enlightenment” is mentioned quite explicitly. So you are accused of a strategy of infiltration by questioning the legitimacy of the current government’s actions and calling on police officers to refuse to obey orders – that’s pretty strong stuff. What do you say to these accusations, which are aimed precisely at you?

Björn Lars Oberndorf: Well, I have of course read through the entire special report. And first of all, I can tell you that the association, represented by me as the first chairman, is also looking into criminal proceedings. But you have to check whether certain criminal offenses, such as defamation or slander, have been committed. It is a complete framing, to put it somewhat objectively. The North Rhine-Westphalia State Office for the Protection of the Constitution is working on the basis of a completely false narrative. It starts with the fact that in the whole special report, what you just mentioned, registered association is not mentioned at all. That is, it is not mentioned at all that “Policemen for Enlightenment” is a proper association registered under German law, that is, a separate legal entity represented by the Executive Board. We have a statute. The statutes clearly state what we are about. It is clearly stated that we operate within the framework of the FDGO and that we are concerned with the proportionality of measures. And if you look at these statements that we want to infiltrate the security authorities from the so-called Corona protester scene, I have of course also marked here. That is exactly wrong. The association was not founded to infiltrate anything. The association was founded, among others, by activists and former police officers who were worried about proportionality. This means that the shoe is on the other foot. That is, it was not founded by Hänschen Müller to indoctrinate police officers, but it was founded by police officers to make their own concerns clear.

Björn Lars Oberndorf: There is a huge difference in terms of intrinsic motivation and narrative. I’m just looking for the page again that you just read out, because the whole thing goes even further, what we are accused of, so to speak. And it is a yes, one can almost speak of it, a very perfidious smear strategy. I would like to remind you of what our Federal Minister of Justice, Mr. Bushman, said a few days ago. He said: “untrue statements of fact or false statements of fact do not belong in the repertoire of democrats”. And when I then read through this report here and what we are accused of here, it is, as you have just correctly said, very hard stuff, because it says here that, among other things, the so-called PolifA, “Policemen for Enlightenment,” Telegram and an Internet site play a significant role. That is what I just meant. Not a word about the registered association, not a word about who our members are, that we have a proper board, that we are properly registered in the register of associations and then what you also read out, refusal of orders. We are not calling on anybody to refuse an order. We are pointing out that if you are not sure that this official action is lawful or the order, the instruction, whatever, that you are then absolutely obliged to remonstrate. Because you must not forget one thing, police officers take their oath on the German Basic Law, not on a Corona Protection Ordinance, not on the Infection Protection Act, but on the Basic Law of our country in the constitutional framework. And that is exactly the reason. You are right, it is a slander.

Milena Preradovic: I’m also wondering, what’s illegal about doubting the legitimacy of government action? Is that not covered by the Basic Law? Am I not allowed to do that?

Björn Lars Oberndorf: Of course. So democracy is an ideal state. We will never achieve democracy, really from a political science point of view. And democracy depends on it, on the responsible citizen. And that also means calling the government to order and questioning government actions. That is exactly what the responsible citizen is supposed to do. And it’s not as if, after more than two years, we don’t have a whole lot of court rulings that prove us right. So it’s not like that. In other words, it’s not as if we’re operating in a vacuum; we’re also referring to court rulings. And it is our duty as citizens to question the legitimacy of government action. And Ulrike Guerot had said so beautifully, “Democracy is public dispute, not consensus presented to the outside world.” And what is here in this report, I think, fits seamlessly into this whole area of what is called cancel culture. What I can say, what I cannot say, what is allowed to be talked about, or as Ms. Dunja Hayali also said so nicely: “But we have freedom of opinion. You have to live with the consequences”. No, that is not what freedom of opinion means according to Article Five of the Basic Law.

Björn Lars Oberndorf: So what does that mean in concrete terms? As First Chairman, I will offer to talk to the State Office for the Protection of the Constitution. I have not done that yet. I will do that. I am announcing this herewith because we are of course prepared to talk at any time. And in parallel, we are examining steps under criminal law, because these are not infiltration strategies. And if there had been a broad discourse right from the start, and if civil servants in particular had been able to voice criticism within the scope of their official duties, the association would probably not have been founded at all.

Milena Preradovic: There is also the report on the protection of the constitution, the current one, the nationwide one. And there, the phenomenon area of delegitimization of the state relevant to constitutional protection has now been introduced. Vague. It’s about people who, in the view of the Office for the Protection of the Constitution, disparage state institutions or their representatives and thus undermine the public’s trust in the state. That, too, was not really illegal. I don’t really have to have confidence in the state either. I have a little suspicion that a new legal system is being introduced here undercover?

Björn Lars Oberndorf: At the very least, you have to ask what the real goal is. We have enough phenomenon areas, extremist phenomenon areas at the Federal Office for the Protection of the Constitution, whether it’s left-wing, right-wing, Islamism, crime against foreigners and so on. These are all these categories, politically motivated crime. And since the Corona protest scene, as the special report also calls it, could not be captured, the delegitimization of the state, which is relevant for the protection of the constitution, was added. And as a criminologist and political scientist, this sends shivers down my spine. Because delegitimization of the state, I don’t want to draw any comparisons, I’m right there in the middle of it, just like disparagement of politicians: There is no democratic duty to trust the state. There is no democratic duty to agree with everything the state does. No, exactly the opposite is the case. Citizens must call the state to order if they feel that certain principles of the rule of law are being abandoned. And especially with this new category, if you look here alone, I am just at the special report, there is also defined the critic of government action. I have to let that roll off my tongue. Who expresses criticism in factual matters, expresses criticism in factual matters and does not want to overcome per se the society in its constitutionality as a democratic constitutional state, nevertheless, this person is seized already sometimes Corona protesters, thus criticism in factual matters. That is a pillar of a free society, a democracy, to express criticism in factual issues and then also here: “the group of the vaccination opponents is to be redefined. To this is counted, who questions and/or rejects the necessity and/or effectiveness of the Corona inoculation”. So then I am vaccination opponent. I am vaccinated against all kinds of things, but I used to be a paramedic, then a police officer. But yes, I question the necessity and the effectiveness. That is correct.

Milena Preradovic: Yes, that’s what various scientists do, that’s what even whole government reports do. And so on. All this comes from the protection of the constitution, where the word already says that the protection of the constitution is supposed to protect the constitution. Does it do that?

Björn Lars Oberndorf: Professor Dr. Moosweg, I think it was, has written an exciting paper on this. This is one of the very controversial questions, also in the field of political science. Because if an authority really protects the Basic Law in the constitutional framework, then this authority would have to be completely independent of external influences. And the State Office for the Protection of the Constitution is of course subordinate to the Federal Ministry of the Interior of North Rhine-Westphalia. The Federal Office for the Protection of the Constitution is subordinate to the Federal Ministry of the Interior. And there is of course already times the question, if I am merged into normal administrative structures and I would like to put now times the question into the area, if necessary only times purely hypothetically, the federal state or Federal Government, which breaks constitution, I however in the structures over the respective specialized ministers is merged, how freely can I then really act and how freely can I really act? After all, one must not forget that the employees of the State Office for the Protection of the Constitution are primarily civil servants. Not all of them, but primarily. That means they are also subject to the Civil Servant Status Act. They are subject to exactly what many of our members are accused of, that is, if they were to make statements or perhaps carry out other actions. I’ll put it objectively and diplomatically: You can ask the question whether the Office for the Protection of the Constitution has really been protecting our constitution for the last two years since March 2020, or whether it has been protecting the government’s actions? And that is just not congruent, even if it is often presented that way.

Milena Preradovic: Well, whether it is only the last two years, but in the last two years is good as a burning glass. That’s what’s often said. Yes, and in the last two years we have also seen how critics of politics, that is, what we have already said, legitimate critics, people who simply question and criticize and also people who have not wanted to be injected, they are systematically defamed, criticized, discredited, marginalized, dehumanized, so to speak, and yes also declared outlawed by politics, as I feel. What does the constitution say about this?

Björn Lars Oberndorf: Well, what our Basic Law says about this in the constitutional framework is very clear. We not only have a protection of minorities in Germany, if we now take for example vaccinated and unvaccinated, but we are all equal before the law. Just to give you an example, we have freedom of speech. There is no censorship. That’s all the constitutional theory. What we have right now just the last two years, you are absolutely right, it is in the last two years certain things are coming to the surface that we have been able to observe for considerably longer is the constitutional reality. And that is exactly the point. There is a very massive, a very massive dehumanization taking place through language. A dehumanization. Not only on the part of politics, but also through the so-called quality or leading media. I call only times a few examples, had I me recently in Hamburg to expressed with a demonstration or meeting. It is about “appendix, social pests, free riders of the pandemic, you can not actually ship to Madagascar”, “must be socially ostracized”. These were all statements and only small examples, which were made by certain representatives of the state and federal government or by respected personalities. There was no outcry, there was no distancing, there was nothing at all. That is dehumanization through language. And if you then really consider how the critics of the measures were dealt with at the demonstrations in some cases, but also how people are dealt with who cannot wear a mask for medical reasons, which in the meantime is regulated by house rules, which is very questionable from a legal point of view. Yes, one gets the impression that these people are in a certain way regarded as outlaws. Right.

Milena Preradovic: Didn’t you somehow report them to people for incitement of the people?

Björn Lars Oberndorf: We have filed quite a lot of charges. So that’s exactly what we are accused of again and again, again and again, that we are, I don’t know, inciting the people. So the movement now not as an association necessarily. I personally have filed quite a few charges because of 130 Criminal Code incitement of the people. And I give you there times an example, so that the inclined listener can grasp that also better. Funk released a game called “Play Corona World” in September 2020 or even earlier, I’d have to look it up now. Funk is Südwestrundfunk. Swr is responsible for it, ARD as the director is responsible for it, and Funk is aimed specifically at young people. And in this game it’s about me playing a nurse who has to disinfect infected people on the way to the supermarket after work, so to speak. So you’ve got to flatten those in the form of a classic jump and run game it. That’s how it’s announced. Children, older people, preppers, that then the right aspect, sunbathers etc and for that I get then points. And this game, if you look at the commentary on the 130 Penal Code, is per excellence Volksverhetzung. It is incitement of the people. But it was not even, not even an investigation was initiated by the prosecution, because in this context it counted then under article five “It’s satire” and there was still 152 StPO no initial suspicion, just to give you an example.

Milena Preradovic: So this is but a game for children and young people. Aha, so children have relatively little to do with satire, I know from experience. They usually don’t even understand irony. So in that respect it’s quite questionable. I have another question about the police. We’ve taken a bit of a different path, which I didn’t ask earlier. We know from the Netherlands that police officers were used undercover as supposed demonstrators to heat up the atmosphere. So at demos like that. And we will probably have demos again. Is there something like that in our country?

Björn Lars Oberndorf: Well, it’s a very complex and very difficult topic as far as this European cooperation is concerned. But yes, there are of course plainclothes police officers who are deployed at gatherings, also in Germany. First of all, of course, also with the task of observing and reporting and, if necessary, also an access preparation, then the BFE units, BFE units are evidence preservation for arrest units. We have had that on all demos, so civilian forces. That there are provocateurs, the suspicion is at least in the room, but not only the last two years. So provocateurs, if necessary, from our own police ranks. We don’t have any proof of that at the moment, and we can’t prove it in court. But if you look at many recordings of demonstrations, if you also look at many quasi detentions and how these people were dealt with afterwards in the protected area of the task forces and how quickly this person was back in the assembly, you can certainly draw this conclusion. But we can’t prove it. So as an important point. But the initial suspicion is there.

Milena Preradovic: So at the next demos, one could perhaps pay a little more attention to it, right?

Björn Lars Oberndorf: Yes, meanwhile almost everything is filmed. And especially from the demonstrations in August 2020 in Berlin, there were already situations that looked very much like that, that not only certain situations should be portrayed for the so-called leading media, but also that certain people have extra provoked police officers. Exactly at that moment they were filmed. This person was then the addressee of police measures, but was then very, very quickly back in the assembly events. That is, it would be a very strange procedure if they were not deliberately provocateurs. Whether they are really police officers is a completely different question, but it cannot be completely ruled out. That is also the point. We saw that in Berlin with the big demonstrations in August, and I have to say that people who may come from the right-wing spectrum are also allowed to demonstrate. They also have basic rights. That has to be mentioned in principle, but I don’t know if you yourself were at the big demonstrations in Berlin in August 2020 and saw these extremely heterogeneous groups of people. It was exciting that sometimes, when certain media representatives were on site, the so-called leading media unfurled a certain flag, which was then rolled up again. These are things that we have documented ourselves as an association and these are already points where I have to ask myself the question, what is the intention of this reporting? The question must be put into the room.

Milena Preradovic: We have to ask ourselves that question. We will probably ask it for a longer time. Mr. Oberndorf, thank you very much for this very interesting insight behind the scenes of the police and behind the scenes of the constitution. When I see that with this constitution and our constitution like that and the constitutional protection, I start to get really worried. But I thank you very much for being there.
